(B)क्या कभी MACP  की 10, 20, 30 की पात्रता  के अन्तराल में कमी आ सकती है?









  क्या 10 वर्ष के पश्चात प्राप्त प्रमोशन MACP की गिनती में आते हैं ?

हाँ ,
यदि  पहला प्रमोशन 10 वर्ष से पहले मिल जाय तो  दूसरा MACP 20 वर्ष से पहले मिलेगा तथा तीसरा 30
वर्ष से पहले मिलेगा । इसी प्रकार यदि दूसरा प्रमोशन 20 वर्ष से पहले मिल जाय तो तीसरा MACP 30 वर्ष से पहले मिल जायेगा ।
चूँकि वेतन उन्नयन जैसे TBOP हनेशा 10 वर्ष के पश्चात ही प्राप्त होते हैं इसलिये इनके कारण कभी भी OFFSET  प्राप्त नहीं होता ।

1-पहली MACP के पश्चात प्राप्त प्रमोशन पर पैरा-4 के अनुसार 3% का लाभ नहीं मिलेगा इसलिए उसे IGNORE करेंगे और गिनती में नहीं लिया जायेगा पैरा 28 B  
2-उसी प्रकार दूसरी MACP के पश्चात प्राप्त प्रमोशन गिनती में नहीं आता। इसलिए उसे IGNORE करेंगे पैरा 28A(iii)

MACP का लाभ देने के लिए नियमित सेवाएं कहाँ से गिनी जाएँगी?

This is always admissible on completion of 10 years of regular service in same grade.

नहीं|
TBOP के आदेश के पैर-1 में लिखा है कि वह  16 वर्षों की सेवा पर मिलेगा । आदेश में कहीं भी नियमित सेवा की बाध्यता नहीं है ।इसीलिए उच्च न्यायालय
ने APS की ADHOC सेवा को TBOP में गिनने का आदेश जारी किया जिसे विभाग ने माना |













पहला प्रमोशन जब 10 वर्ष के अंदर प्राप्त होगा तब वह दूसरे तथा तीसरेMACP  के लिए OFFSET पैदा करेगा।
पैरा  28 A (i) &(ii)
दूसरा प्रमोशन जब 20 वर्ष के अंदर प्राप्त होगा तब वह तीसरे MACP के लिए OFFSET पैदा करेगा । पैरा  28 B 




नहीं ,
क्योंकि  TBOP किसी भी कैडर में हमेशा 10 वर्ष बाद ही प्राप्त होगा ।कभी वह प्रथम उन्नयन के रूप में प्राप्त होगा और कभी दूसरे उन्नयन के रूप प्राप्त होगा ।
पैरा  28 B  पहले प्रमोशन (10 साल बाद तथा 20 वर्ष के अंदर( को OFFSET पैदा करने से रोकता है तथा  28 A(iii) दूसरे प्रमोशन (20 साल बाद तथा 30 वर्ष के अंदर)  को OFFSET पैदा करने से रोकता है ।













हाँ ,
इसके अलावां पैरा 4 की यह व्यवस्था कि MACP प्राप्त होने के पश्चात प्रमोशन पर  3% का लाभ  नहीं मिलेगा इस प्रमोशन को IGNORE करने का सबूत है ।
चूँकि 10 वर्ष एक ग्रेड में रहने पर MACP देना अनिवार्य(PARA-1) है इसलिए 10 वर्ष पश्चात  प्राप्त होने वाले सभी प्रमोशन/  उन्नयन को IGNORE करना ही पड़ेगा ।




















 IGNORE करने पर नियमित सेवा पिछली MACP से गिनेंगे ।

क्या MACP का लाभ PROMOTION की ग्रेड पे में मिलेगा ?
Should the benefit be extended in the next higher grade of promotion in the corresponding cadre?





Not necessarily.
MACPS benefit is given to immediate higher grade of pay as per the recommended revised Pay Bands and Grade Pay as given in Section 1, Part -A of the First Schedule of Revised Pay Rules, 2008.

What would be the highest possible Grade Pay, up to which the benefit can be extended?
Up to the maximum Grade Pay of Rs.12000 in

Pay shall be raised by 3% of the total pay drawn before up gradation in the Pay Band & Grade Pay.

क्या प्रथम MACP होने के पश्चात प्राप्त प्रमोशन पर कोई वितीय लाभ होगा ?
(a)    Junior Clerk joined in GP Rs.   1900/-
(b)   1st MACPS benefit in GP Rs.2000/- with pay fixation.     Thereafter
(c)   1st Promotion as Sr. Clerk in GP Rs. 2400/-.
What will be the monetary benefit?
Being the same numbered promotion as of MACPS, there will be no further fixation after MACPS benefit. Only difference in GP (Rs. 1900 to Rs.2800/-) is payable.

ऐसा प्रमोशन जो उसी संख्य MACP के पश्चात प्राप्त हुआ हो ,कोई वित्तीय लाभ दे पायेगा ?
Should there be pay fixation at the time of same numbered regular promotion as that of MACPS benefit?
At the time of actual promotion, even it happens to be in a post carrying higher Grade Pay than what is available under MACPS; no pay fixation would be available. Only difference of Grade Pay would be made available.

(A) पिछली सेवाओं के अनुसार ENTRY GRADE से 10 वर्ष के अन्तराल पर MACP प्रदान करेंगे । उस कर्मचारी का पे फिक्सेशन किन चरणों में करेंगे?
What would be the steps for pay fixation in this scheme?




FOR EXAMPLE:
(i) On 23.08.1996 joins in GP-Rs.1900/-;
(ii)On 01.09.2008 he is Eligible for MACPS benefit, if not promoted on completion of 10 yrs & effective date of actual financial benefit 01.09.08.
(iii)The Pay should be fixed by granting him one increment (3%) plus the difference of grade pay (Rs.2000-Rs.1900= Rs.100/-)

क्या वे प्रमोशन जो छठें वेतन आयोग के पश्चात सामान ग्रेड पे में होतें हैं MACP की गिनती में आयेंगे ?

Will promotions that were earned or upgradations that were granted due to ACP Scheme carry same GP due to merger of pay scales or upgradations of posts shall be counted?
No. It should be ignored.

उस कर्मचारी की ग्रेड पे क्या होगी जिसने 25 वर्ष की सेवा के पश्चात पुरानी दो ACP प्राप्त कर की हैं ?
In a case – An employee  recruited in pay scale Rs.5000-8000-/-(Pre-revised)
1st ACP  Up gradations in Rs.5500-9000/- and
2nd ACP in 6500-10500/-respectively.
 What will be the grade pay as per MACPS?
(a). Recruitment grade pay – Rs.4200/(PB-2)

(b).For 10 yrs regular service ,GP Rs.4600/(PB-2)

(c). For 20 yrs of service, GP Rs.4800/ (PB-2)

उस कर्मचारी की ग्रेड पे क्या होगी जिसने 25 वर्ष की सेवा के पश्चात दो प्रमोशन  प्राप्त कर की हैं ?
In a case – An employee  recruited in pay sale Rs.5000-8000-/-(Pre-revised)
1st  promotions in service in Rs.5500-9000/- and
2nd promotion 6500-10500/-.
What will be the grade pay as per MACPS?
Since Recruitment and next promotion were in
PB 2, GP 4200/-. Therefore, the employee is eligible for
(1) One up gradation to GP Rs.4600/-(PB-2) for 10 yrs regular service and
(2) Another up gradation to Rs.4800/-(PB-2) for 20 yrs. regular service.

उन ACP वेतन मान प्राप्त कर्मचारियों का 1-1-2006 को कौन सा  REPLACEMENT वेतन प्राप्त होगा?
What will be the reference pay for revision as per VI CPC in case of the employees is running under  ACPS benefit as on  01.01.2006?
Revised pay will be with reference to the pay scale granted to them under the ACPS.

1-1-2006 तथा 1-9-2008 के बीच ACP प्राप्त कर्मचारियों को नए वेतनमान में pay fixation OPTIONs क्या है ?

What should be option available to an employee, who has got the benefit of ACPS between 01.01.2006 to 01.09.2008?
Such employees has the option to have his pay fixed with reference to pre-revised pay either (a) w.e.f 01.01.2006 or (b) w.e.f date of financial up gradation under ACPS. In case of (b) the employee will be eligible for arrear from the date of his/her option,

ACP प्रदान करते समय यदि उस पद की ग्रेड पे उच्चीकृत हो गयी है तो ACP ग्रेड पे क्या देंगे?

In a case- JE (in Pre revised scale Rs.5000-8000/- got 1st ACPS benefit in Rs.6500-10500/- . What will be his revised grade pay if the post corresponding to ACP is upgraded?
Upgraded grade pay.

MACP प्राप्त होने पर pay fixation options क्या मौजूद हैं ?
How fixation of pay would be done on grant of MACPS benefit?

The employee has an option under FR 22(i)a)(i)  to get fix pay in higher post/grade pay either from the date of promotion/up gradation or from the date of next increment viz 1st July of the year. The pay and date of increment would be in accordance with clarification no. 2 of OM NO 1/1/2008/IC dated 13-09-2008. Para-7of Annexure-I

छठें वेतन आयोग के लगू होने के पश्चात यदि कोई कर्मचारी उस पद पर प्रमोशन पता है जिस पर ग्रेड पे सामान है तो क्या उसे MACP में गिनेंगें ?

After implementation of 6th CPC ,in case of promotions earned in the post carrying same grade pay in the promotional hierarchy as per recruitment rules, whether it will be counted for the MACPS Benefit?
Such promotions with same grade pay shall be counted for the purpose of MACPS.

क्या PB -II की 5400 तथा PB -III की 5400, MACP के लिए अलग ग्रेड पे मानी जाएगी?
Should grade pay of Rs.5400/- in PB-2 and PB-3 be treated as separate grade pay for MACPS?
Yes, Similar grade pay with different pay bands will be treated as separate grade pays for MACPS.

नियमित सेवा किसे कहतें है ?
What is regular service?



Period of service that commences from the date of joining post in direct entry grade on a regular basis either on direct recruitment basis or on absorption/re- employment basis.

नियमित नियुक्ति के पहले की ADHOC /CONTRACT सेवा को MACP की गिनती में लेंगे ?
Should the service rendered on ad hoc / contract basis before regular appointment on pre-appointment training shall be taken into reckoning?
No. Such period shall not be taken into reckoning.

नएविभाग में आने से पहले की गई उसी ग्रेडपे में सेवा को क्या नियमित सेवा की गिनती में ली जाएगी ?
Should past continuous service in same grade pay in a post carrying same grade pay, prior to regular appointment in new department, without break, in another department be considered for MACPS?
Yes. Previous service in another department will be counted for MACPS (but not for regular promotions).

राज्य सरकार /स्वायतशासी संस्थायों की सेवायों को क्या गिनती में लेंगे ?

Should the past service rendered in state government/statutory body/autonomous body/public sector undertaking organization be counted towards regular service?
No.

Should the period spent on deputation, foreign service, study leave and all other kind of leave (duly sanctioned) be included in regular service?

Should the service rendered against work-charge post be counted?
Yes, if their service conditions are comparable with the staff of regular establishment.

(A) समय बद्ध उन्नयन सेवाओं का भविष्य क्या होगा ?

(a)What will be the fate of existing time bound promotion scheme including in-situ promotion scheme or such other kind of scheme for particular category of employees?

(B)TBOP /BCR स्कीम कब ख़त्म हुई?
When the TBOP/BCR withdrawn
Competent administrative authority to decide, whether to retain such schemes or to switch over to MACPS. However, both the schemes shall not run concurrently. Para-13 of Annexure-I

आगे प्राप्त होने वाली MACP पर क्या कोई प्रभाव होगा  जब पिछली MACP अयोग्यता के आधार पर 10/20वर्ष से परे दी गई हो ?

Should there be any consequential effect on subsequent financial up-gradation in case benefit under MACPS is deferred and not allowed after 10/20 yrs. in a grade pay due to the reason of the employee being unfit or due to departmental proceedings?









Yes.

This Para gives evidence that under ordinary circumstances the period of 10 or 20 years or 30 years for grant of MACPS cannot be deferred.


It is for this reason 16 years of service of TBOP in a cadre cannot make any offset for further MACPS and is ignored.

MACP लाभ के लिए क्या RESERVATION ROASTER /ORDER लागू होगा ?
Should Reservation Roster/Orders be implemented?
MACPS contemplates merely placement on personal basis in the immediate higher grade pay/grant of financial benefits only and shall not amount to actual /functional promotion of the employees concerned. Therefore, Reservation rules are not applicable.

(A)वह वर्ग अ  जो 1-9-2008 को 30 वर्ष की सेवा पूरी कर  चुका है तीसरी MACP का हकदार बन जाता है । उसका पे फिक्सेशन कैसे करेंगे?


In a case – a Group A employee, not covered under ACPS has become entitled to 3rd financial up gradation directly. How his pay should be fixed?


(B) पैरा-22
के अनुसार प्रत्येक 10 वर्ष के अन्तराल पर  MACP की  पात्रता जरूर बनती है तो क्या उसका लाभ पहले पा जाने के कारण उसको पे फिक्सेशन में नहीं लेते हैं।

के अनुसार प्रत्येक 10 वर्ष के अन्तराल पर पहली व् दूसरी MACP  की पात्रता के कारण तथा उसका लाभ अभी तक न मिलने के कारण  प्रत्येक दोनों पात्रता पर 3% का लाभ देते हुए पे फिक्सेशन करेंगे|


His pay shall be fixed successively in next three immediate higher grade pays in the hierarchy of revised pay bands and grade pays allowing the benefit of 3 % pay fixation at every stage.

If an employee, declare surplus in his department, is appointed in the same pay scale or lower scale of pay in new organization, how MACPS be implemented?
The regular service rendered in previous organization shall be counted towards regular service in the new organization for the purpose of giving up-gradation under MACPS.

रूल 38 में कैसे लागू है ?

Will an employee be eligible for this benefit in case s/he after getting promotion/ACP benefit seeks unilateral transfer to a lower post/scale?

The employee will be entitled for 2nd and 3rd up-gradations on completion of 20 & 30yrs. of regular service from the date of initial appointment to the post in the new organization.

Para-24 of Annexure-I. Now it has been revised vide DOP&T OM No. dated 04-10-2012.
That promotion will not be, thus, counted for further MACPS.

MACP लागू होने से पहले यदि किसी ने प्रमोशन अस्वीकार किया है तो क्या पैर 25 लागू होगा?

What will be the fate of those employees who have refused regular promotion before implementation of MACP?




चूँकि अपने यहाँ प्रचलित TBOP स्कीम में इस प्रकार के बन्धनों पर दंड के अपने प्रावधान थे जिन्हें कर्मचारियों ने भोग लिया है इसलिए MACP के आने के पश्चात नए नियम का बोझ अनुचित होगा ।वैसे भी दो बार दंड देना अनुचित होगा
 अतः पैरा  11 का प्रावधान कि  बीते केसेज नहीं खोले जायेंगे के अंतर्गत पैरा -25 के प्रावधान पिछले केसेज पर नहीं लगेंगे ।

MACP लागू होने पर STAGNATE करने के बावजूद नियमित प्रमोशन को अस्वीकार कर देने पर MACP का भविष्य क्या होगा ?

What will be the fate of those employees who has got financial up-gradation due to stagnation and subsequently refused the promotion?



The employee will not be eligible to be considered for further financial up-gradation till he agrees to be considered for promotion again and the 2nd and next financial up-gradation shall also be deferred to the extent of period of debarment due to refusal.

ADHOC कर्मचारी को MACP कैसे प्रदान करेंगे ?
How the scheme will be applicable to ad hoc employees?


Such employees would be allowed the benefit considering his/her notional pay to the substantial post and the pay will be fixed considering the benefit of this scheme vis-à-vis pay drawn on ad hoc basis.

क्या MACP प्राप्त करने के लिए DEPUTATION छोड़कर कर पुराने विभाग में आना पड़ेगा ?

Should the employee on deputation be reverted to parent department for this benefit?

No. She may avail MACPS benefit and exercise a fresh option to draw the pay in his deputation or the pay as per MACPS.

What is the difference between MACPS and TBOP/BCR scheme?

Whether ACPS 9-8-99 and MACPS 1-9-2008 are similar in nature. Whether they are considered simultaneously in MACPS 19-05-2009?
(A)
MACPS is applicable from entry grade and regular services are to be counted from there. It cannot be granted twice in career of employee.
In case 1st promotion after 10 years of regular service is earned then it is to be ignored for further MACPS and 2nd MACPS is granted after 10 years from 1st MACPS and not from 10 years of 1st promotion.
In case 1st promotion is earned before 10 years of service then it has capability to create offset for 2nd and 3rd MACPS.
Whereas TBOP/BCR scheme is applicable to any of the cadre up to PA/SA and counts only completion of16 years of service in a particular cadre which are not necessarily regular service. An employee can gain it more than once in his career and has no capability to create offset for further grant.
